General Terms and Conditions for the Purchase of Online Gift Cards

1. Scope

The following General Terms and Conditions apply to all orders through our online shop or on site that concern products from the online shop.

1) General

The contract is deemed concluded with Hospiz Alm Restaurant GmbH. Any deviating conditions shall apply only if these are mutually and expressly agreed in writing. Only persons aged 18 or over are eligible to make purchases in our online shop.

2) Conclusion of contract, payment and delivery

The gift cards offered on the website represent a non-binding purchase offer that is subject to change. Prices given include the applicable statutory VAT. An order for a gift card through the internet or instructions to a Hospiz Alm employee via telephone, by email or in person to purchase a gift card constitutes a binding offer to purchase by the customer. The purchase contract comes into being upon payment, which in turn is dependent on the method of payment selected. Following receipt of payment of the amount owed on the basis of the concluded purchase contract, the gift cards are issued for printing or sending digitally, or will be sent using the method selected, or are handed out directly to the customer.

3) Gift cards

It should be noted that the online gift cards are transferred to the customer by Hospiz Alm Restaurant GmbH with a forgery-proof code. Since the customer can print the gift cards out themselves, it is possible to make several copies; however, only one copy is valid and redeemable. The first gift card to be redeemed in the INCERT voucher management system with the corresponding barcode will be considered the original and must be debited immediately after redemption by Hospiz Alm Restaurant GmbH. Should further copies turn up with the same code, this is considered a misuse, which will carry consequences under penal law. Since the gift card can be passed on or gifted accordingly, Hospiz Alm Restaurant GmbH has no obligation nor opportunity to verify the ownership rights of the person redeeming the voucher. Upon receipt, it will merely be checked if the corresponding barcode has been approved by the system and if the gift card in question has been paid in full. 

Lost gift cards will not be replaced. Moreover, gift cards cannot be returned against a cash payment. If the value of the gift card exceeds the cost of the services used, a new gift card to the value of the remaining sum will be generated. In such a case, there shall be no claim to a cash payment of the remaining sum. Hospiz Alm Restaurant GmbH is not obligated to accept gift cards that have not been paid in full as a method of payment. For operational reasons, the services specified in the gift card can only be rendered/guaranteed by the provider if a corresponding reservation has been made in good time in advance. Where the gift card is a voucher for services, the service described therein may deviate slightly depending on the circumstances. However, this shall not constitute a relevant reduction in value for the guest. If Hospiz Alm Restaurant GmbH has to close or discontinue the business, the online gift cards become void without compensation. This is also the case if the business demonstrably changes hands. In this case, claims cannot be brought against Hospiz Alm Restaurant GmbH as the original issuer of the gift card. 

4) Validity, duration of validity

Gift cards for a certain value have no expiry date and can be redeemed at any time. Service voucher gift cards are redeemable after enquiry in advance and according to availability; they are valid for one year from the date of issue. After expiry of the one-year validity period, the service voucher is converted into a gift card for a certain value and can be redeemed within another 29 years against purchases up to the value of the amount originally paid. Any increases in price for the services specified on the gift card must be borne by the customer after one year from the date of issue. Each gift card can be redeemed only once, as ensured by the barcode or gift card number associated with the gift card.

5) Cash payout, invoicing 

The gift card or the value on the card cannot be redeemed against cash. An invoice for VAT purposes with the corresponding tax information can first be issued when the gift card is redeemed and thus upon actual performance of the service. 

6) Security guarantee, data privacy 

Your security is our highest priority. Therefore, when paying by credit card, data such as a credit card number, bank code, account number, name and address are transmitted through certified payment service providers and via their protected SSL channels in compliance with PCI guidelines. This means that no unauthorised persons can read your data while it is being transmitted. We use a series of additional security measures to ensure extra security in the gift card shop. The information you provide is processed by us with the help of automatic procedures. This data is not passed on to third parties.

7) Exchange, right of withdrawal

Gift cards that do not meet your expectations can be returned to us within 14 days of their issue. It is required that the written (withdrawal) declaration is received by Hospiz Alm Restaurant GmbH within 14 days. However, there is no right of withdrawal if the use of the service has already begun within the withdrawal period. This right to return applies only to customers who qualify as consumers. Hospiz Alm Restaurant GmbH cannot replace gift cards that are lost, stolen or devalued.

8) Place of jurisdiction

Austrian law applies exclusively for all contractual relationships. 

Place of jurisdiction is the regional court, Austria.
